These Terms & Conditions ("Terms") govern your use of polypulse3d.com (the "Site"), operated by PolyPulse3D ("we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. What We Offer

PolyPulse3D is an informational and marketing website for a set of Maya pipeline plugins ("Tools"). The Site itself does not process payments. All purchases of our Tools are made through Gumroad, Inc., a third-party e-commerce platform, and are subject to Gumroad's own Terms of Service.

2. Intellectual Property

The Site's design, text, graphics, logos, and the PolyPulse3D name and brand are the property of PolyPulse3D and may not be copied, reproduced, or used without our prior written permission, except as needed for normal use of the Site (e.g. browsing, sharing links). Your license to use any purchased Tool itself is governed separately by the End User License Agreement (EULA), not by these Terms.

3. Purchases

When you purchase a Tool, your transaction (including payment, billing, and delivery of your download) is handled entirely by Gumroad. We are not responsible for payment processing errors, billing disputes, or issues with Gumroad's platform; those are governed by Gumroad's own terms and policies. Once you have downloaded a Tool, your right to install and use it is governed by our EULA.

4. Refunds

Refund requests are handled on a case-by-case basis. If you have an issue with a purchase, contact us through our contact page with your order details, and we will do our best to help. We do not guarantee refunds in every circumstance.

5. Acceptable Use

You agree not to:

• Use the Site's contact form to send spam, unsolicited advertising, or malicious content
• Attempt to gain unauthorized access to the Site, its underlying systems, or accounts
• Use the Site in any way that could disable, damage, or impair its operation
• Misrepresent your identity or affiliation when contacting us

6. Third-Party Links and Platforms

The Site links to third-party platforms, including Gumroad, Discord, X (Twitter), LinkedIn, and GitHub. We do not control these platforms and are not responsible for their content, availability, or practices. Your use of any linked platform is governed by that platform's own terms and privacy policy.

7. Disclaimer of Warranties

The Site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the fullest extent permitted by law, PolyPulse3D shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from or related to your use of the Site. Our total liability for any claim arising from these Terms or the Site shall not exceed the amount you paid us directly, if any, in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold PolyPulse3D harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Site or violation of these Terms.

10. Governing Law

These Terms are governed by the laws of India, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the competent courts in India.

11. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
